Forensic mechanical engineering support for patent litigation is substantially different from other forensic engineering practice. For instance, in a non-patent related case such as a failure analysis or an accident investigation, a forensic engineer might conduct a technical analysis to determine if the loss was caused by a design defect, operator error, material deficiency, or a combination of factors. While knowledge of legal concepts, such as defect or negligence, is required, the forensic engineer’s focus is primarily technical, and he must provide a clear and convincing explanation of the technical findings and their underlying logic, most often to a non-technical audience.

In contrast, while expert engineering technical analysis is also required for patent cases, patent litigation additionally requires a forensic engineering expert to operate in a professional context that uses different logic approaches and methods than those engineers may be accustomed to. A patent case may, for instance, use its own definitions for specific terms, which have been thoroughly argued before being agreed to or ruled on. Additionally, each case comes equipped with its own specific issues, which often hinge on subtle differences in nuance and language. The forensic engineer who successfully assists with patent litigation must not only be capable at technical analysis, but must also quickly learn and understand the specific industry and invention at issue, as well as be adept at learning and applying what might seem to be arcane arguments about subtle differences of wording in the case language.

Finally, while consistent attention to detail is the required hallmark of the successful forensic engineering expert’s work in all forensic cases, for patent dispute cases an even greater degree of focus on minutiae is required than is typically called for in other areas of litigation work.
