Outcomes from an accident, or adverse incident—whether a large catastrophic event, or something smaller and more mundane— frequently result in damage to property, personal injury and/or financial loss and thus often end up in the legal system. In such cases, scientific investigation into the causal factors is necessary to assist a court in establishing the facts and evidence of the case. An example might be products liability cases.

Forensic mechanical engineering is also employed in legal cases involving intellectual property issues such as patent disputes.

While a good forensic accident investigation focuses on the requirements of the case, it also attempts to formulate and consider all possible causes, including those potentially favorable both to the client and to other parties.


Of course, not all cases advance fully through litigation. Results from a sound forensic investigation can provide information that assists the client when considering actions such as: paying a claim, going forward with legal action, preparing for mediation, or negotiating a settlement.
